At ANIMADECO® we understand the protection of personal data as an opportunity to generate value for our users. By using personal information responsibly, we not only protect the privacy of those who entrusted us with their data, but we also allow them to operate with security and confidence in our ecosystem. Providing voluntary, express and informed consent to this Privacy Statement is an essential requirement to be able to contract and/or have any type of relationship with ANIMADECO® depending on the applicable legislation in each country.

The personal data provided will be kept for the time necessary to fulfill the purpose for which it is collected and to determine the possible responsibilities that may arise from the purpose, in addition to the periods established in the archives and documentation regulations.

ANIMADECO® collects personal information so that Users can enjoy our services, and to continuously improve them.

In some cases, the information is provided by the User, when registering or providing information when using any of the Portal services. In others, data is collected automatically, such as when the User browses the pages and uses the services. In turn, ANIMADECO® collects information about Users from other reliable sources.

1.1. Data and information collected

ANIMADECO® may collect the following types of data:

Information provided directly when registering or using the Services:

– Nickname or pseudonym to operate on the ANIMADECO® platforms 

– Name, personal image (personal photo or photo of the document)

– Document number and valid tax identification

– Proof of tax status in the country of residence of each user 

– Contact information (phone number, address, email address)

– Information on intellectual property rights

Information collected automatically:

– Information about the devices or computers from which the ANIMADECO® platform is accessed and other automatically captured data (such as the type or version of the browser or operating system, settings, connection data, information about some of the downloaded applications and parameters).

– Internet IP address used when connecting to our services or when browsing our websites. 

– Certain information about user and visitor activity within our website and apps. Such as, for example, the URL they come from or which URL they next access (whether or not they are on our website). Also the pages visited, the interactions with said pages, the searches carried out, the publications, purchases or sales, ratings and responses entered, complaints made and received, messages in the forums, among other information may be stored and retained.

– Location information (geolocation), used to offer personalized content visibility.

– Contact lists of mobile devices used by users to provide different services, such as sending money between accounts.

– Links between accounts and users, for fraud prevention actions.

– Data for claims and trial management (information for the preparation of documents, background information and strategies).

– For those who do not access through your Personal Account, ANIMADECO® will only collect and store, in addition to the information indicated in this point, cell phone numbers, e-mail addresses and emails sent to the Portal.

ANIMADECO®  will process the information provided by the User for different purposes, depending on the method of data collection:

Access to the Portal, which allows:

Registration, identification and contact of Users. 

Identity verification in compliance with legal requirements.

Validation, updating and correction of information.

Direct contact with the seller and/or buyer user in order to materialize the different transactions.

Preparation and maintenance of records of operations.

Making the electronic commerce platform and the online payment system available to Users.

2. Comply with legal obligations and requirements of competent authorities.

Comply with the regulations that apply to ANIMADECO®  in general.

-Compliance with regulations for the Prevention of Money Laundering and Financing of Terrorism (identity validation actions (KYC), identity verification against -Politically Exposed Persons, profile verification and transactional history, in compliance with the applicable regulations on prevention of money laundering, verification against OFAC lists and others), as applicable in each country.

-Compliance with information regimes in general, as applicable in each country.

-Compliance with tax collection, registration, information, audit and billing regimes, at any level of government (for example: federal, state and municipal level).

-Compliance with information requirements of competent administrative or judicial authorities.

-Provide user information to government entities with collaboration agreements for the fulfillment of their powers.

3. Detect and prevent fraud, abuse and related crimes to protect the security of our users and the sustainability of the platforms.

-Make platforms grow in a sustainable and safe way through tools and actions to prevent fraud and related crimes.

Train the automated fraud detection and prevention algorithm model.

4. Protect rights of users, third parties or those of ANIMADECO® 

-Defend the rights, tangible and intangible assets of ANIMADECO® 

Enforce the rights of ANIMADECO® in the event of breaches of its Terms and Conditions.

Allow other users or third parties to assert their rights.

5. Collaborate with intellectual property owners in the exercise of their rights

-Collaborate with the protection of intellectual or industrial property rights, own or third parties, investigations of violation of trademarks and patents, as well as counterfeits.

-Facilitate the resolution of disputes between Users that identify infractions and violations of Intellectual Property.

-Collaborate with entities involved in resolving disputes.

-Collaborate with private entities that represent collective interests with a collaboration agreement, to facilitate the resolution of disputes.

6. Make advertising and promotional announcements and contacts.

-Contact through different channels (by email, short text messages (SMS), push messages, phone calls or any other means) for advertising and/or promotional purposes of products and services of ANIMADECO® and/or third parties.

Carry out all types of marketing, advertising, commercial prospecting and/or market research activities.

The use of the data for any other purpose that is not compatible with those detailed will be communicated before proceeding with its processing.

ANIMADECO®  will keep your personal information for the period necessary to fulfill the purposes for which it was collected.

Manage the relationship established between ANIMADECO® and the User.

Provide the services requested by the User.

Manage, administer, expand and improve the services to which the User has decided to subscribe or register.

Adapt these services to improve their quality for the User.

Send information required by the User.

Send information about modifications to the products or services contracted by the User.

Send information about new products or services in the sector and other related sectors that may be of interest to you by any means, including electronic means. 

1.2. Recipients of information and Disclosure of information

The data that ANIMADECO®  collects about the User may be transferred to and stored at a destination located at XXXX. By submitting your personal data you agree to the aforementioned transfer, storage and processing. We will do everything necessary to ensure that your data is processed securely and in accordance with this privacy policy. The User accepts the possibility of disclosing personal data to subsidiaries, parent company, commercial allies of ANIMADECO®. 

Protecting privacy is very important to ANIMADECO®.  Therefore, no information that identifies Users will be marketed, nor will Users' personal information be transferred to third parties, except as indicated below:

ANIMADECO®  may assign, transmit and/or transfer your personal information to: 

(i) "Service Providers": service providers or companies are third parties that we hire to act on behalf of ANIMADECO® to provide a service following our instructions and in accordance with the provisions of this Privacy Statement, to contribute to improve or facilitate operations through our platform, such as: (a) transport, logistics, courier and parcel companies, to send you the products you purchased, (b) means of payment, intermediaries in payment management or insurance, for obtain payment for the contracted services or products, as well as provide you with protection regarding the purchased products, (c) computer system providers, cloud service providers, database providers, and technological service providers in general, ( d) call centers or customer service centers, (e) companies that manage loyalty or loyalty programs, to grant you benefits, (f) advertising or marketing agencies, (g) data analysis, (h) collection agencies, (i) government entities or companies specialized in Intellectual Property management, among others. These Service Providers only access the information strictly necessary to provide the agreed services and cannot use them for purposes other than those entrusted to them by ANIMADECO®.  

(ii) “Commercial allies”: companies with financial or commercial activities with which ANIMADECO® has a collaboration or alliance relationship, with the purpose of offering you promotions, products and services from said companies or co-branded companies. In these cases, ANIMADECO® always ensures that confidentiality and security standards are met, through the signing of agreements or agreements whose purpose is the privacy of the personal data of our users and compliance with applicable legislation.

(iii) "ANIMADECO® Group": companies that belong to our corporate group, that operate under our same internal processes and policies, whether they are controlled, controlling or affiliated companies with ANIMADECO®, to comply with our internal regulations, prevent fraud, manage risks and facilitate the management of ANIMADECO® services and products.

(iv) “Counterparty in the transaction”: other users of the ANIMADECO® platforms, under the conditions provided, with the purpose of putting you in contact with the seller or buyer for the purposes of the transaction you wish to carry out.

(v) “Public authorities”: the administrative and judicial authorities that, in the exercise of their jurisdiction, require information, even if there is no executive or judicial order or subpoena for this purpose, with the purposes of: (a) collaborating in the investigation and reporting fraud, piracy, violations of intellectual or industrial property or any other illegal activity, as well as any activity or circumstance that could generate legal liability for ANIMADECO® and/or its users; (b) safeguard a public interest, the procurement or administration of justice, the recognition, exercise or defense of a right in a judicial or administrative process, and/or the resolution of disputes; and (c) comply with any applicable law, regulation or legal provision, or with any duly founded and motivated mandate from a competent authority.

(vi) “Users who claim violation of their Intellectual Property”: for the purpose of defending the intellectual property rights that are marketed through ANIMADECO® upon formal legal request.

(vii) "Participants in Disputes": authorities, friendly arbitrators, courts or entities that intervene in the resolution of disputes with the purpose of resolving controversies that may arise between users or between them and any of the companies in the ANIMADECO corporate group. ® 

Likewise, ANIMADECO®  may disclose your personal information at its discretion to other users of the Websites and/or Services, entities or third parties when there are sufficient reasons to consider that your activity is suspicious of attempting or committing a crime or attempting to harm other people.

If ANIMADECO® decides to share your personal information with third parties other than those mentioned, we will request your prior and express consent, as long as there is no authorization or legal obligation that allows it to be done without that consent.

Likewise, you give your express and informed consent for ANIMADECO® to assign, transmit or transfer your personal information to the recipients detailed in this Privacy Statement.

The services provided by ANIMADECO® require the support of a technological infrastructure, such as servers and cloud services, which may be our own or provided by third parties.

Part of that infrastructure may be established in a country other than yours. It may also happen that the recipients of the data indicated above are in a different country. The countries receiving the data we transfer may not offer adequate levels of personal data protection, in accordance with applicable regulations.

In these cases, ANIMADECO® adopts measures to safeguard your data, through contractual clauses or binding corporate rules that impose the same protection measures as those described in this Privacy Statement.

Finally, DANIMADECO® will not be responsible for the improper use of your personal information made by any third party when these third parties are the ones who directly collect and/or process your personal information.

1.3. Mandatory or optional nature of the requested information

The mandatory data for each form will be identified as such on the form itself as an affidavit. Refusal to provide said information will prevent the service requested by the User from being effective. 

1.4. Exercise of rights

The User consents to the processing and transfer of their data for the purposes described, without prejudice to their right to revoke said consent through the procedure established for the exercise of their rights of access, rectification, cancellation and opposition or, where applicable. , by sending an email to  info@animadeco.es specifying your request. It is ANIMADECO®'s intention to exclusively collect information that has been provided voluntarily. ANIMADECO® uses the personal data it collects for lawful purposes, seeking continuous improvement in the activities it carries out and in the relationship it maintains with its clients, suppliers, employees, control organizations and third parties. 

The legal basis for these treatments will be your express consent, which you may revoke at any time. Meanwhile, the data will be processed indefinitely over time. Any User may, at any time, request free updating and rectification of their personal data contained in the database, as well as the total or partial withdrawal or blocking thereof, by sending an email to info@byanima. com.ar

1.5. Automation and profiling

Users understand and accept that ANIMADECO® may use tools that help make processes more efficient through techniques known as “artificial intelligence”, “machine learning” or “Big Data” that are used for various purposes, such as fraud prevention, analysis and prediction of economic capacity, personalization of services and advertising, automated cybersecurity mechanisms or identity validation through image recognition.

Automated decisions are those that are made based on the use of algorithms and computer programs, without any human being intervening in the decision-making process.
